Immigration Start-up Visa

The UK is currently ranked ninth in the world for global competitiveness, according to the World Economic Forum in 2019. This score is based on a wide range of key factors for business, including, quality of infrastructure, a stable macroeconomic framework, efficiency of goods markets, developed financial markets, and the ability to harness existing technology. It is for these reasons that many start-up entrepreneurs from outside of the European Economic Area (EEA) wish to set up in business in the UK. The UK Tier 1 (Start-up) Visa is specifically geared towards individuals from outside of the EEA who have a business idea which is different from any existing offerings – in other words, it is innovative. Our London based immigration lawyers can assist you with all matters relating to a UK Tier 1 (Start-up Visa).

At AQ Archers Solicitors, we understand that as an entrepreneur, your time needs to be focused on nurturing your new business idea. We will manage your Start-up Visa application on your behalf, seeking input only when necessary and advising you at key stages through the process. Our highly experienced Innovator Visa immigration specialists have assisted many entrepreneurs with preparing their UK Visa applications, overcoming any challenges which arise with the minimum of delay and inconvenience.

What is the Tier 1 (Start-up) Visa?

The Tier 1 (Start-up) Visa, which replaced the Tier 1 (Graduate Entrepreneur) Visa, was introduced in March 2019 for anyone wishing to come to the UK to launch their innovative and viable business idea. As such, the Start-up Visa is not simply restricted to graduates or individuals with investment capital. Successful applicants will be allowed to remain in the UK for an initial two years, after which they will be able to apply to switch to the Tier 1 (Innovator) Visa route.

Am I eligible for the Tier 1 (Start-up) Visa?

In order to apply for the Tier 1 (Start-up) Visa, you will need to meet a number of criteria as defined by the UK Home Office, including that you:

  • Are over 18-years old
  • Have a business idea which is new and viable
  • Have a business idea endorsed by an approved body
  • Meet the English language requirements (by passing an approved English language test or by having a recognised degree, masters, or PhD taught in English)
  • Have sufficient funds to support yourself (£945 in your bank account for 90 consecutive days before you apply).
  • If you are unsure if you meet the eligibility criteria, it is important to seek the advice of an immigration Solicitor before submitting your application. Doing so will provide you with the confidence that your application has the best chance of success.

Why should I engage AQ Archers to assist with my Start-up Visa application?

AQ Archers have been assisting entrepreneurs with their immigration needs for many years. What sets us apart is that our specialist Start-up Visa immigration Solicitors have an enviable combination of legal expertise and business acumen. We believe that in order to represent and advise businesspeople, you have to be a businessperson at heart.

Understanding what the UK Home Office is looking for from prospective applicants is essential to ensure you have the best possible chance of success in your Visa application. If we spot any possible flaw in your business idea or plan, we will quickly advise you on the steps necessary to resolve it. As such, you can rest assured that we will be honest and transparent from the outset of handling your matter, through to successful completion.

Can AQ Archers assist with the refusal of a Start-up Visa?

Yes, we have assisted many applicants who have had their business Visa applications refused to secure a positive decision. Because our team have a forensic knowledge of the guidelines followed by endorsing entities and Home Office case officers, we will focus in on the problem area/s. We will then recommend a plan of action to resolve the matter, whether this is in the form of a resubmitted application, appeal, Administrative Review, or a Judicial Review. In our experience, most adverse decisions are quickly overturned when we write to the Home Office to challenge an adverse decision robustly.

AQ Archers, based in London, can assist you with all aspects of obtaining ILR based on long residence for you and your family. To speak to one of our consultants, please call 020 8521 2605.
