Divorce and Separation

There a few events in life which are more stressful and emotionally traumatic than divorce. Regardless of the circumstances, making the decision to separate from your partner is often very difficult and can leave us feeling vulnerable and worried about the future. At the same time, practical decisions need to be made for the benefit of those separating and their children. Can I file for a divorce?

Under current law, in order to file for divorce, you and your spouse must have been married for at least one year, your relationship must have broken down irretrievably, your marriage or civil partnership must have been legally recognised in the UK, and the UK must be your permanent home (or that of your wife or husband).

There are five grounds for divorce:

  • Adultery
  • Unreasonable behaviour
  • Desertion
  • Living Apart for More Than 2 Years
  • Living Apart for More Than 5 Years (does not require consent from your husband or wife)

 

What is the process of divorce?

You will first need to apply for divorce and pay a fee of £550 – this process can be completed online on the UK Government website. Once your application for divorce is submitted, you will receive a notice that ‘acknowledgement of service’ has been sent to your husband of wife informing them of the intention to divorce, a copy of your application stamped by the divorce centre, and a case number.

Your husband or wife then has eight days to confirm they agree or that they will defend the divorce, and whether they object to paying for the divorce fees. They will then have 28 days to explain why they disagree with the divorce. If they agree to the divorce, you can then apply for a decree nisi, using the form relevant to the reason for the divorce.

If the judge agrees, the decree nisi will be granted – you will then need to wait for 43 days until you can apply for a decree absolute to end the marriage legally.
