The UK family Visa scheme enables individuals from outside of the EEA to live with their UK based spouse or partner. Am I eligible for a Spouse or Partner Visa?

In order to be eligible to apply as a partner, you will need to show that:

  • you and your partner are 18 or over
  • your partner is a British citizen, has settled in the UK (they will need to have permanent residence), or has refugee status or humanitarian protection in the UK

When you apply, you will need to provide evidence that you are in a civil partnership or marriage recognised in the UK, or you have both been together in a relationship for at least two years.

If you are planning to get married or enter into a civil partnership with a UK citizen or resident within six months of arriving, you can still apply.

If you don’t meet any of these requirements, you may still be able to apply if:

  • you have a child in the UK who is a British citizen
  • you have a child in the UK who has lived in the UK for seven years or more
  • there would be very significant difficulties for you and your partner if you lived together as a couple outside the UK
  • it would breach your human rights to stop you coming to the UK or make you leave

If you are unsure if you meet the eligibility criteria, it is important to seek the advice of an immigration Solicitor before submitting your application. Doing so will provide you with the confidence that your application has the best chance of success.

 

How long can I stay in the UK on a spouse or partner family Visa?

Under the present immigration rules, if your application is accepted, you will be able to remain for 2.5 years. If you are applying as a fiancé, fiancée or proposed civil partner, you will be allowed to stay for six months. In either scenario, you can then apply to extend your stay.
