Am I eligible for Indefinite Leave to Remain (ILR)?

In order to be eligible for ILR, you will need to fulfil the following criteria:

  • You must be a national of a country outside of the EU/EEA (EU nationals can apply under a separate route referred to as the EU Settlement Scheme)
  • Lived in the UK continuously (continuous residence) for the qualifying period (see below)
  • You must not have been absent from the UK for more than 180 days in any 12 months of the qualifying period
  • Have passed the Life in the UK Test
  • Meet the English language requirements

Qualifying period for ILR

The qualifying period for ILR is typically five years, except for the following Visa types:

  • Tier 1 (Investor) Visa – two, three, or five years depending on the level of your investment
  • Tier 1 (Entrepreneur) – three or five years depending on the type of business activity
  • Tier 1 (Exceptional Talent) visa – three years
  • Long residence – 10 years
