The process of divorce can lead to considerable emotional and financial worry, especially where children are involved. It is important to reach an agreement on where your children will live predominantly, and how their time will be divided between each parent. Where possible, we encourage parents to find a mutually agreeable and amicable plan for their children without the need to involve the Courts. You will need to decide:
- where your children will live
- how much time your children will spend with each parent
- how you will both contribute financially to raising your children
What is the process of putting in place child arrangements?
If an agreement is reached, there is no legal requirement for this to be documented, but it is highly recommended that you ask a Solicitor to formalise the arrangements reached by way of a consent order. This can then be used as a point of reference in the future by a Court if needed. To apply for a consent order, a C100 form should be completed (available on the Government Website) and submitted with the application fee and your draft Consent Order.
What if we cannot agree on child arrangements?
If it is appropriate, mediation can be used to find solutions to child arrangement matters, whether there is some existing agreement or not. In our experience, mediation can prove very effective in finding a compromise between parties. If this does not resolve the matter, it can then be decided by the Courts.
The Courts can issue a Child Arrangement Order (CAO), and/or a Specific Issue Order. A CAO will stipulate the child’s living and contact arrangements, whereas a Specific Issue Order can be used for matters such as the school the child will attend and/or if they should receive a religious education.
