What is the process of putting in place child arrangements?
If an agreement is reached, there is no legal requirement for this to be documented, but it is highly recommended that you ask a Solicitor to formalise the arrangements reached by way of a consent order. This can then be used as a point of reference in the future by a Court if needed. To apply for a consent order, a C100 form should be completed (available on the Government Website) and submitted with the application fee and your draft Consent Order.
What if we cannot agree on child arrangements?
If it is appropriate, mediation can be used to find solutions to child arrangement matters, whether there is some existing agreement or not. In our experience, mediation can prove very effective in finding a compromise between parties. If this does not resolve the matter, it can then be decided by the Courts.
The Courts can issue a Child Arrangement Order (CAO), and/or a Specific Issue Order. A CAO will stipulate the child’s living and contact arrangements, whereas a Specific Issue Order can be used for matters such as the school the child will attend and/or if they should receive a religious education.
